Client Alert #4/2023. Changes in Social Security contributions for self-employed

As of 1/1/2023, Royal Decree-Law 13/2022 of 26 July 2022 establishes that the contribution that the self-employed should pay to the Social Security will be calculated according to the income that they are expected to receive from their business/professional activity during the year.

The self-employed person will have to choose the monthly contribution base that will correspond to them according to the forecast they make of the net income that their average will receive.

To calculate an estimatedb net income:

- You must estimate how much net income you will receive annually and apply a general expenses deduction of 7% for self-employed individuals and 3% for self-employed companies.

- The annual obtained net income must be divided by 12 months.

According to your monthly income, after applying the above calculations, you can find out the monthly cost of social insurance contributions. This means that you could choose between the minimum or maximum contribution according to the income section bellow. Find out more on the following published sheets:

If during the calendar year you realise that the estimation initially made is incorrect, you can change your contribution base up to six times with the following terms:

- from May 1, if the request is made between March 1 and April 30.

- from July 1, if the application is made between May 1 and June 30.

- from September 1, if the application is made between July 1 and August 31.

- from November1, if the application is made between September 1 and October 31.

- from January 1 of the following year, if the application is made between November 1 and December 31.

You must remember that the chosen base will be a provisional one until it’s fixed in the following year when the income return is filed.

Therefore, in case your provisional base is not correct one according to your income return, a regularisation of your social security contribution will be made.
